1. Acceptance of Terms

By accessing or using BALIA OS ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

BALIA OS is an AI agent operating system that enables users to deploy and manage AI agents for business automation. The Service includes the software platform, skill cassettes, affiliate program, and related services available at baliaos.com.

3. Affiliate Program

Participation in the BALIA OS affiliate program is subject to the following conditions:

• You must provide accurate registration information
• One affiliate account per person or entity
• Commission rates are as stated at the time of referral and may change with notice
• Commissions are earned on one-time product purchases only (for example the T1 + 1-year bundle). Subscription payments — monthly or yearly, first payment or renewal — are not eligible for commission, regardless of the payment method used
• Commissions are paid only on verified, non-refunded purchases
• Commissions from credit card purchases (via Lemon Squeezy) become eligible for payout 35 days after the purchase date, to allow for refunds and chargebacks. If the purchase is fully refunded before then, the commission is cancelled. Commissions from crypto payments (USDT / presale) are not subject to this waiting period
• Self-referrals are prohibited and will result in commission forfeiture
• Spam, misleading claims, or fraudulent activity will result in immediate account termination

4. Payments

Solana USDT-SPL payments are processed to the wallet address you provide. You are responsible for providing a correct and compatible wallet address. BALIA OS is not responsible for funds sent to incorrect addresses provided by you. Blockchain transactions are irreversible.

BALIA OS T1 is sold with a required subscription (monthly or yearly). The subscription renews automatically until you cancel it, and you can cancel at any time from your account. Card payments are processed by Lemon Squeezy, which acts as the merchant of record for those purchases.

You may also pay for the T1 + 1 Year Bundle in Solana USDT or USDC (SPL), at the same price. These payments are a one-time payment covering the first year; they do not renew automatically. To continue after the first year you make a separate yearly renewal payment. You must pay from a wallet you control, using the payment link or QR code we show you, and the amount must match exactly — payments sent from an exchange withdrawal, in another token, on another network, or for a different amount cannot be matched automatically to your order and may be lost.

5. Refunds

Because this is a digital product delivered immediately, purchases are non-refundable once delivered, except where required by applicable law.

Purchases paid in Solana USDT or USDC are final and non-refundable. Blockchain transactions cannot be reversed by us, and we do not offer refunds, cancellations or pro-rata credit for those purchases or their renewals.

If a purchase is refunded for any reason, including a chargeback, the access token issued for that order is deactivated.

Where a purchase is refunded, including by chargeback, we may restrict future purchases and the use of our membership programs, including the points program and affiliate payouts, by the same person or payment account.

6. Intellectual Property

All content, software, and materials on BALIA OS are owned by or licensed to BALIA OS. You may not copy, modify, distribute, or reverse-engineer any part of the Service without express written permission.

7. Prohibited Conduct

• Using the Service for unlawful purposes
• Attempting to circumvent security measures
• Submitting false or fraudulent information
• Interfering with the Service's operation
• Creating multiple accounts to circumvent restrictions

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. BALIA OS does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, BALIA OS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms. You may terminate your account by contacting us at info@baliaos.com.

11. Changes to Terms

We may modify these terms at any time. Material changes will be communicated to registered users via email. Continued use constitutes acceptance of the modified terms.
